SUAP Platform

The SUAP (Sportello Unico per le Attività Produttive) represents the one-stop shop for all the administrative proceedings related to production and services, including “agricultural, commercial and artisanal activities, tourist and hotel activities as well as services provided by banks, financial brokers, and telecom operators, …”. All the proceedings related with actions of localisation, construction, transformation, restructuring, reconversion, expansion, transfer, as well as cessation or reactivation are managed here.

General information

Service Description

All front-office phases and processes for receiving user paperwork and technical attachments are automated at SUAP one-stop shop.

The citizen who wishes to start a business requiring SCIA or other authorization can only submit the application electronically to SUAP by means of the Chamber of Commerce application named impresainungiorno.

The requesting user is guaranteed a single and timely electronic response in place of the other municipal offices and all the public administrations involved in the procedure (competent authorities), including those responsible for environmental, landscape-territorial protection and the historical-artistic heritage or the protection of public health and safety.

Exceptions from the application of the SUAP regulation (D.P.R. 160/2010) are:

  • energy systems and infrastructures;
  • activities related to the use of sources of ionizing radiation and radioactive materials;
  • nuclear and radioactive waste disposal plants;
  • hydrocarbon exploration, research and cultivation activities;
  • strategic infrastructures and production facilities of pre-eminent national interest (ref. arts. 161 and following - D. Lgs. 12/04/2006, n. 163).

SUAP one-stop shop only operates in electronic mode, also with regards to payments: it provides a payment system for taxes, fees and other charges, however named, related to the completion of applications.

So, all the probable communications are conveyd through SUAP digital portal: questions, declarations, reports, and technical specifications can be submitted, exclusively electronically, to the SUAP of the Municipality of Naples by means of the Chamber of Commerce application called impresainungiorno.

The two Decrees of the President of Republic n.159 and n.160 of 7 September 2010 containing the new regulations regarding the agencies for business and the one-stop shop for production activities (SUAP) respectively, were published in the Official Gazette n.229 of 30 September 2010.
The two regulations implement the paragraphs 3 and 4 of art.38 of the Legislative Decree n.112 of 25 June 2008, entitled "Business in a day" and intend to be functional not only to the design of semplification of procedures and organizational structures, but also to the promotion and relaunch of the production system, contributing to lightening the phases connected to the realization or modification of the business activity. The publication of the two regulations is an important phase of a complex process which involves a lot of implementation obligations and complex organizational activities by a variety of public and private entities, aimed at making all the provisions of the new regulations fully operational from 30 September 2011.

 

The new digital channel

Questions, declarations, reports, and technical specifications can be submitted, exclusively electronically, to the SUAP of the Municipality of Naples by means of the Chamber of Commerce application called impresainungiorno.
Acting as a single gateway, SUAP electronically forwards the documentation to the other administrations possibly involved in the procedure, which are required to come back with the proper response quickly. Such administrations are not allowed to communicate with the applicant directly.
Therefore SUAP will guarantee the applicant a single and timely response hiding all the other public administrations involved in the procedure, including those responsible for the protection of the environment, landscape, historical-artistic heritage or the protection of health and safety.

The certified start of activity report (SCIA)

In case the activity falls within the scope of the so-called "automated procedure" (article 5 of Presidential Decree no. 160/2010), the applicable regulation requires that the certified start of activity report (SCIA) to be submitted to the SUAP.
The application will be subjected to a formal regularity check by SUAP. In case of positive outcome the applicant may start the business at once.

The authorization process

In case the activity does not fall within the scope of automated procedure, the application is submitted to the SUAP which, within thirty days of receipt (or shorter deadlines established by further regional regulations), may request additional documentation from the applicant. After this deadline the application is considered correctly submitted.
Once the completeness of the documentation has been verified, the SUAP adopts the final measure within the following thirty days (shorter deadlines may apply by further regional regulations), otherwise it calls a services conference whenever it is necessary to acquire agreements, clearances, concerts or consents by other public administrations based on the provisions of law 241/1990, or other sector regulations, also at the request of the applicant or the Agenzia per le Imprese.
The services conference is always called if the procedure necessary to acquire the agreements, clearances, concerts or consents takes more than ninety days or when provided by regional regulations.
Once the 60 day deadline has expired or when the services conference has not been invoked, the art. 38, paragraph 3 letter h) of the Legislative Decree n. 112/2008 shall apply.
In that case, the proceeding administration concludes the procedure regardless the opinions/consents documents not issued; except the case of missed notification request, the manager in charge of the procedure cannot be held responsible for any damages resulting from the missed issue of the opinions/consents themselves.

Entry into force

Most of the provisions of the regulation, and in particular those referring to the activities subject to the SCIA, came into force from 29 March 2011, while the remaining part referring to the single authorization procedure came into force from 1 October 2011.

The exclusions

The following items are excluded from the scope of the regulation:
- energy systems and infrastructures;
- activities related to the use of sources of ionizing radiation and radioactive materials;
- nuclear and radioactive waste disposal plants;
- hydrocarbon exploration, research and cultivation activities;
- the strategic infrastructures and production facilities referred to in the articles. 161 et seq. (Chapter IV) of Legislative Decree no. 163/2006.

Costs and Payment

Payments of the new investigation fees starting from 2 July 2021

As a result of City Council Resolution no. 249 of 17 June 2021, the administration introduced some changes, in force since July 2, 2021, regarding the investigation fees of SUAP online proceedings.

More in details:
1. Some fees, already established with City Council Resolution no. 373 of 27 July 2018, have been modified;
2. New fees are introduced for some online proceedings which were free (e.g. SCIA for wholesale trade or car repairers);
3. Nevertheless, other fees are confirmed: e.g. the SCIA for small neighborhood stores which represent a procedural area of particular interest.

    - Further proceedings not listed in Table A attached to Legislative Decree no. 222/2016 but still subject to investigation fees;

    Clarifications

    1. It is specified that all investigation fees included in the table attached to DGC no. 373 of 27 July 2018 but not explicitly included in the DGC n. 249 of 17 June 2021 are to be considered still in force. For this reason, the table of investigation fees attached to DGC no. 373 of 27 July 2018 is made available below;
    2. For proceedings consisting of multiple internal proceedings (e.g. SCIA UNICA, SCIA CONDIZIONATA and Procedimento Unico Ordinario), the amount of the fees is obtained by the shopping cart logic, i.e. the amount to be paid is equal to the sum of the amounts associated to the single proceedings.

  • SUAP and PagoPA investigation fees

    Citizens are advised that starting from 10pm on 22 March 2021 it will no longer be possible to transmit SUAP electronic procedures via the online SUAP application. Starting from March 23, 2021, impresainungiorno will be the main electronic channel for handling SUAP proceedings.

    Joining impresainungiorno also changes the way of paying the processing fees of SUAP proceedings. As of March 23, 2021, these fees will be paid, exclusively, through the pagoPA portal present in impresainungiorno app (https://www.pagopa.gov.it)

  • How to make payments

    To correctly pay the investigation fees, we recommend to adopt the following procedure:

    Step 1
    - Identify the sub-area of ​​interest among those present on the first page of new fees table;
    - Click on the link associated with the sub-area of ​​interest (if you have opened the browseable table) or reach the relevant tab manually;
    - If the sub-area of ​​interest is not present among those explicitly provided in table A attached to Legislative Decree no. 222/2016, check the pages:
    --- AUA;
    --- Additional new amounts for SUAP proceedings;
    --- In the old table of fees.

    Step 2

    Shopping cart logic

    Using impresainungiorno application it is possible to transmit non-atomic proceedings (i.e. consisting of multiple internal proceedings) such as the SCIA UNICA and SCIA CONDIZIONATA (as provided by the so-called Madia reform, Legislative Decree 30 June 2016, n. 126 and Legislative Decree 25 November 2016, no. 222).
    To pay the investigation fees for such proceedings, the shopping cart logic applies: i.e. the amount to be paid is equal to the sum of the amounts associated to the single internal proceedings
    For example, consider a case of SCIA UNICA to report the opening of a bar in which a commercial bar opening SCIA and a health notification combine. The overall amount of the investigation fees to be paid in this case is equal to €120, obtained as the sum of €100 for the commercial procedure and €20 for the health notification procedure.
    By extension, this logic must be used whatever is the combination of atomic procedures to be transmitted to the SUAP.

  • The fees to be paid to other administrations

    For administrations other than Municipality of Naples, the fees must be paid according to the methods reported on the relevant institutional websites.
    Receipts of payment of these additional fees (not SUAP) must be attached to the paperwork to be sent to SUAP via impresainungiorno.

  • How to pay the investigation fees still unpaid as of March 23, 2021

    To pay the fees relating to proceedings present in SUAP but still under preliminary (therefore transmitted before 23 March 2021), and subject to a request for integration or conformity or for which it was spontaneously realized that the due payment has not been made, it is necessary to follow what is reported in the following guide.
